Casework applications and decisions

I have submitted a request/application to the Commission’s casework team - what does the Act mean for me?

The Commission is continuing with all its usual regulatory work, which includes assessing all requests and other casework matters which have been submitted. These decisions are currently being made at Commissioner level.

Under the new legislation, certain decisions may be delegated to staff in the future which will create greater efficiency. However, these must first be set out in a Scheme of Delegation, which will be consulted on before approval by the Department for Communities.

Our charity received a consent / scheme / order from the Commission before May 2019 – does the Act affect those?

The Act means that the consent / scheme / order your charity received before May 2019 is considered to be valid and to have always been valid. This means that it is in full force and effect, and any actions the charity took in line with it are also considered to be valid.

I disagree with a registration or casework decision which has been made valid by the Act. Are there appeal rights available to me?

The Act provides new appeal rights to certain decisions, and there are time limits for making such an appeal. Further information on this is available here: New appeal rights.
