Sub-clause (e) Purpose To make donations to or for the benefit of any of the following Churches: i. Dungiven Parish Church ii. Bovevagh Parish Church iii. Banagher Parish Church iv. balance of income arising in that year and remaining after providing for expenditure What benefit flows from this purpose? Monies are put at the disposal of churches in the East Londonderry region. As the beneficiary churches are themselves established for the advancement of the Christian religion, the benefit to the public is an increased ability of the churches to spread the religion in that region owing to increased resources. The benefits of the Christian religion are well known, and include spiritual benefits for worshippers, as well as material benefits for recipients of charitable acts of individual Christians. How could you demonstrate this? The accounts of the beneficiary churches would show the monies being lodged and put at their disposal. Thus clear evidence of increased resources for the spread of the Christian religion would be available. Is any harm or possibility of harm outweighed by the benefit? It is not clear that any harm would arise from this benefit. However, it may be argued that advancing Christianity may disadvantage other religious groups, although it is not clear that this could be described as “harm”. Who is the benefit for? The benefit is for all those living in East Londonderry who may avail of the services provided by the beneficiary churches. Is there any private benefit? Is it incidental or necessary? There may be benefits to some employees of the beneficiary churches, but these are necessary to the achievement of the benefit. Sub-clause (f) Purpose Subject to sub-clauses (a) to (e) hereof the Trustees shall pay any balance of income in their hands at the end of each year to the Treasurer of the Parish of Dungiven (Church of Ireland) as an addition to the sustentation fund of such parish What benefit flows from this purpose? Monies are put at the disposal of Dungiven Parish Church, allowing it to pursue the advancement of the Christian religion more easily in East Londonderry. The benefits of the Christian religion are well known, and include spiritual benefits for worshippers, as well as material benefits for recipients of charitable acts of individual Christians. What your organisation does

The Trust manages the property entrusted to it by the Church of Ireland in the parish of Dungiven, Co Londonderry, using the excess proceeds to provide financial support to the churches named in its founding Trust Deed, as well as needy members of the congregations of those churches. These activities are carried out with a view to the promotion of

the Christian religion in Co Londonderry by means of a concrete manifestation of Christian charity in the local area.

Charitable purposes

The Trustees shall apply the moneys forming the Income Fund for the following purposes: (a) In payment of the expenses of the Trust including the payment of any Agent employed by them to collect the rents and manage and supervise the real property of the Trust (b) In the repair and maintenance and improvement of such real property (c) In the creation at their discretion of a reserve fund for future repair maintenance and improvement of such real property (d) In the repayment by instalments rateably of all moneys received by them as “repayable loans” provided that in the event of the death of any lender, or in case of individual hardship the Trustees in their absolute discretion may repay any sum loaned to them by way of repayable loan in priority to ant other such loan and may repay the same out of any part of the “Capital Fund” (e) To make donations to or for the benefit of any of the following Churches: i. Dungiven Parish Church ii. Bovevagh Parish Church iii. Banagher Parish Church iv. Dungiven Presbyterian Church v. Bovevagh Presbyterian Church Provided that the total amount of such donations in any one year shall not exceed one third of the balance of income arising in that year and remaining after providing for expenditure under sub-clauses (a) and (b) of this paragraph (f) Subject to sub-clauses (a) to (e) hereof the Trustees shall pay any balance of income in their hands at the end of each year to the Treasurer of the Parish of Dungiven (Church of Ireland) as an addition to the sustentation fund of such parish
