Below you can find the Commission’s recent and proposed decisions on casework requests and other matters submitted to the Charity Commission for Northern Ireland.
Proposed schemes
We publish proposed schemes so the public can see them and submit comments. Any feedback received during the notice period must be considered, and the proposals may be amended as a result.
Consents to regulated alterations
Under the Charities Act (Northern Ireland) 2008, certain changes to a charitable company’s Articles of Association need Commission approval before they can take effect. This includes any changes to:
- the charity’s objects.
- the dissolution clause.
- permissions allowing directors to receive benefits.
Prior written consent from the Commission is required for these changes. More detail is available in the Consents for charitable companies section of our website. The Current regulated consents table in the sidebar shows regulated orders and consents issued in the last 12 months.
Approved schemes
Where the Commission is satisfied that it is in the best interests of the charity, it has powers to authorise:
- any action proposed by a charity or,
- transactions which are not normally a proper use of the charity’s resources.
Where the charity trustees have no power, but consider themselves under a moral obligation to do so, the Commission can:
- authorise a charity to apply property
- waive entitlement to receive property.

The Commission has made an Order to authorise Charity Proceedings in the Chancery Division of the High Court of Justice in Northern Ireland, pursuant to s.54(2) of the Charities Act (NI) 2008 upon the request of persons interested in the charity known as Camphill Community Clanabogan NIC101781: Sealed order – Camphill Community Clanabogan.

The Commission has made an Order to authorise the trustees of Irish Evangelistic Band (NIC101702) to make a resolution to transfer all of the assets and liabilities from Irish Evangelistic Band (NIC101702)) to Irish Evangelistic Band (NIC109471) as part of the organisation’s change of legal structure from unincorporated association to an incorporated legal entity (a company), notwithstanding that a conflict of interest arises as the trustees of the charity are also the directors of the company: Sealed order – Irish Evangelistic Band (NIC101702).

The Commission has made an Order under Section 46 of the Act authorising the trustees of Irish Evangelistic Band (NIC109471) to provide an indemnity to the trustees of Irish Evangelistic Band (NIC101702) as part of an arrangement whereby Irish Evangelistic Band (NIC109471) will receive all of the assets and liabilities of Irish Evangelistic Band (NIC101702), notwithstanding that a conflict of interest arises: Sealed order – Irish Evangelistic Band (NIC109471).
