Public benefits
Broadly stated, the organisation’s Objects can be distilled to one overarching Purpose; The establishment, maintenance and management of an integrated community facility for the benefit of the Ballykelly and surrounding area with the facility being used directly for recreation and leisure activities or in which other statutory and voluntary
agencies may provide services aimed at easing disadvantage or improving education. The trustees believe that the purpose of the organisation satisfies both elements of the public benefit requirement. The direct benefits flowing from the purposes include the provision of a central hub for organisations concerned with promoting the social well-being, development and integration of the community of Ballykelly, an enhancement in the social ambience and recreational well-being of the local area’s inhabitants and improved access to such services and activities. Wider benefits will be gained by groups in the local community who have found it difficult to source accommodation at an affordable cost and through reduced operating costs. This may also have the outworking of encouraging economic development and allowing such organisations to maximise their human resource pools. These benefits will be evidenced from feedback from our tenants, their continuing occupancy and use of facilities, from resident groups and the local community itself. There is no evident harm which would arise from these purposes. The company's centre of operations , Loughview House, has been secured on a long-term lease from a company owned by a trustee. Any private benefits arising from this agreement, such as improvements to the value and function of the property, are by-products of carrying out of the purposes of our organisation. These private benefits are incidental and necessary to ensure that the benefits outlined above are provided to our intended beneficiaries. The acquisition of this long-term lease also means that conflicts of interest may arise regarding our connection with this privately owned company. Where a conflict of interest should arise, the affected Trustee (s) will not be allowed to participate in any decisions whether they stand to gain, whether directly, or indirectly through a connected person. They shall be absent from the part of the meeting at which there is discussion of the decision being proposed, they will not vote on the matter and will not be counted when considering whether a quorum of Trustees are present at that meeting. The overriding principle in any decision-making process is that the Trustees making the decision should be able to demonstrate that their decision was made only in the best interests of Loughview Enterprises Ltd and its objectives. This principle is to be adhered to throughout the lifetime of the organisation. The beneficiaries will be “the inhabitants of Ballykelly and district area”, an area in which many homes are occupied by young families, low incomes families or people who are in receipt of benefits.
